These terms and conditions apply to all offers made by Zwemschool Amsterdam and to all agreements it concludes.
In these terms and conditions, the following definitions shall apply: participant the natural person taking swimming lessons at Zwemschool Amsterdam; other party the contracting party of Zwemschool Amsterdam website, the online website zwemschool-amsterdam.nl
2. Activities
Providing swimming lessons to children and adults with the goal of obtaining various swimming certificates.
Organizing vacations with swimming lessons.
To encourage and teach water-related activities for various diverse audiences.
3. Register
The agreement between the parties commences on the date of signing the registration form and/or after payment of the
Enrollment is always valid until revocation.
Diplomas are only for the swimmer's motivation and not a time of automatic termination of the agreement.
The agreement is for a minimum term of 12 months or as agreed upon at the front of the registration form and is thereafter terminable subject to what is described in Article 11.
4. Class schedule
During the year, all classes are taught according to a schedule.
The days and times of classes may be adjusted on an interim basis.
Classes also continue during vacations according to the schedule on the website of Zwemschool Amsterdam.
During national holidays, there will be no classes
Days when there are no swimming lessons are listed in the parent portal.
5. Illness or absence
Lessons missed due to occasional illness or absence for other reasons will not be deducted nor reimbursed.
For every 2 lessons cancelled at least 12 hours prior, 1 lesson can be made up.
If there is a prolonged absence (at least 4 lessons) due to illness or otherwise, please notify the student by email. After a notification, the student will be removed from the swim lesson group and payment will continue. Settlement will take place afterwards minus 2 lessons excess.
6. Graduation site
Graduation swimming takes place in an appropriate pool, which may be different from the location where lessons are held
7. Parent/caregiver attendance.
The swim instructor/ice will determine on a case-by-case basis whether it is better for a child whether the parent/caregiver's presence in the swim hall is desired.
The instructions of the swim instructor/ice should be followed at all times
8. Graduation and trial swimming
Zwemschool Amsterdam issues various swimming certificates. A current list is on that provider's website.
The trial swim should be prior to the swim-off Attendance at this is a prerequisite for graduation.
A few days prior to trial swimming and diploma swimming, you will receive an invitation to this.
Participation in trial swimming does not guarantee participation in diploma swimming.
9. Payment
By signing the registration form, you consent to the automatic debiting of tuition and related
Tuition is collected once a month in advance.
The cost of diploma swimming is not included.
If payment is not made on time, the other party shall be legally in The other party shall then owe statutory interest.
In the event of a reversal or payment other than by direct debit, Zwemschool Amsterdam will charge a € 6.00 administration fee.
If the other party is in default in the fulfillment of its obligations, all reasonable costs incurred to obtain satisfaction out of court shall be for its account. Extrajudicial costs are calculated on the basis of what is customary at that time in the Dutch collection practice, currently the Wet Normering Buitengerechtelijke Kosten.
10. Price Change
Zwemschool Amsterdam is entitled to increase its rates annually.
11. Termination
Termination is possible after the expiration of the minimum subscription period (Article 3.4).
Notwithstanding the foregoing, termination is also possible with effect from the price change as mentioned in Article 10, insofar as it exceeds an increase based on the Consumer Price Index figure.
Subject to the foregoing, the agreement may be terminated by the end of a payment period and subject to a payment period.
Termination should be done through the appropriate form on the Zwemschool Amsterdam website.
12. Safety
Zwemschool Amsterdam makes every effort to prepare and teach all classes with the utmost care for safety.
Any physical limitations or health risks should only be reported at registration so that the swimming instructor/ice can take these matters into account during the lessons. Zwemschool Amsterdam is therefore never liable for damage caused by unreported risks.

13. Liability
Zwemschool Amsterdam is not liable for damages resulting from force majeure, such as when classes cannot take place due to illness of its employees or (fire) damage to the building in which classes are held
Zwemschool Amsterdam is exclusively liable for damage suffered by the other party which is a direct result of a shortcoming attributable to Zwemschool Amsterdam . The liability of Zwemschool Amsterdam towards the other party and towards third parties is always limited to the amount actually paid out by the liability insurer, increased by the amount of the excess according to the relevant policy.
If at the time of entering into the agreement it is not possible for Zwemschool Amsterdam to take out insurance as referred to in paragraph 1 or to renew it thereafter on reasonable terms, compensation for damages shall be limited to the amount charged by Zwemschool Amsterdam for the agreement from which the damages arise (excluding VAT)
The other party indemnifies Zwemschool Amsterdam against third-party claims for compensation for damages, to the extent that such claims exceed the provisions of Article 14(1), (2) and (3).
The limitation or exclusion of liability stipulated in this article does not apply to the extent that damage is the result of intentional acts, gross negligence or deliberate recklessness of Zwemschool Amsterdam and/or its employees.
Zwemschool Amsterdam is authorized to accept terms and conditions that apply to the relationship between it and a third party it engages or that are stipulated by the third party, including limitations of liability, also on behalf of the other party, without prejudice Zwemschool Amsterdam shall be entitled to invoke these terms and conditions against the other party insofar as the performance of the assignment by the third party is concerned.
Zwemschool Amsterdam is not liable for the manner in which third parties perform their work and is not liable for any shortcomings of these third parties, except for intentional, gross negligence or deliberate recklessness on the part of Swim School
14. Refund monies
If you are excluded from participating in classes, you are not entitled to a refund of tuition already paid.
In the event of lessons not taking place due to force majeure as a result of (one of) the class locations being unusable, there will be no refund of tuition.
No refunds will ever be made.
15. Privacy Protection
Personal data will be used by Zwemschool Amsterdam only for the work described herein.
16. Disputes
All disputes between Zwemschool Amsterdam and you will be governed by Dutch law.
All disputes between Zwemschool Amsterdam and you shall be submitted exclusively to the competent court in the district where User is located
17. Final Provisions
By paying the registration fee and/or signing the registration form, you declare that you have received, understood and accepted these terms and conditions
